In New South Wales, every swimming pool and spa capable of holding more than 300mm of water must meet strict pool barrier and safety standards. A swimming pool compliance certificate is the official document confirming your pool barrier meets the requirements of the Swimming Pools Act and the relevant Australian Standard. It's issued after a qualified certifier inspects your pool.

When do you need a compliance certificate?

You'll typically need a valid compliance certificate when you:

  • Sell a property with a pool or spa.
  • Lease a property with a pool or spa.
  • Have just built or installed a new pool or spa.
  • Want to confirm an existing barrier is safe and registered.

Every pool must also be listed on the NSW Swimming Pool Register. A compliance certificate, once issued, is generally valid for three years (unless the barrier changes).

What the inspection covers

A certifier checks that your pool barrier:

  • Is at least the required height with no climbable footholds nearby.
  • Has gaps below and between vertical bars within the allowable limits.
  • Has a self-closing, self-latching gate that opens away from the pool.
  • Maintains a non-climbable zone on both sides of the barrier.
  • Displays a current, compliant CPR resuscitation sign.

What happens if the pool fails?

If the barrier doesn't comply, you'll receive a report listing exactly what needs to change. Once the issues are fixed, a re-inspection confirms compliance and the certificate is issued. Common fixes include adjusting gate latches, removing climbable objects near the fence and updating signage.
